Description

Abstract
自2019年起蔓延全世界的新冠肺炎疫情對國際社會造成重大衝擊,然而,各區域、國家、各產業亦因疫情震度、廣度之不同而受到不同程度之影響。部分產業遭受重大衝擊,部分產業卻面臨極端需求,甚至有部分產業基於公益之考量有相互合作、協議之需求,基此,研究團隊針對本次研究案主題,盤點國內外保健防疫、日常生活與民生必需用品零售業、資通訊應用業等相關產業,於疫情期間面臨之產業結構變化,並深入探討新冠肺炎對產業經濟之影響。 其次研究團隊將分別蒐集及分節撰寫2020年美國司法部與包括阿肯色、佛羅里達、佐治亞等11個州對谷歌聯手提出之訴訟、德國訂定「因應新冠肺炎疫情減輕競爭法及商業自治組織法相關法律後果法」、歐盟反托拉斯主管機關對Valve等6家遊戲開發商開罰780萬歐元等相關事件,輔以其他亞洲國家之具體案例,了解國內外競爭法執法機關於經濟巨變下所面臨之重要議題與政策執行,並著重以新冠肺炎疫情期間從各國競爭法主管機關之具體操作與判斷作為研究主軸,作為未來提供我國競爭法主觀機關之具體執法建議。 最後,研究團隊規劃辦理1場專家座談,邀集競爭法與產業界相關之專家學者參與座談會(未來視疫情狀況研議是否改以線上方式舉辦),確保研究團隊提出之具體執法建議兼容實然面與應然面,更能夠以前瞻性之產業視野,涵蓋所有相關領域。 Since late 2019, the COVID-19 pandemic has caused a major impact on the international community and global economy. Different regions, countries, and industries have also been affected to varying degrees due to the magnitude and breadth of the epidemic. However, the epidemic also created medical and health care needs, and even a range of industries are now operating based on public welfare considerations. Today there are also needs for cooperation and agreement globally and domestically. The research project focuses on the important themes of current time and a wide range of industries, including communication and health care, household and retail products, and other high-tech industries. We will look at the changes of these targeted industries and markets in the era of the epidemic and examine the long-term economic impacts on the industries. In addition, the research team will collect and analyse the lawsuits filed by the U.S. Department of Justice against Google Inc in 2020 and related cases in 11 states, including Arkansas, Florida, Georgia and other states. In Germany, the government has formulated the ‘Competition Law and Business Autonomous Organization Law’ in response to the COVID-19 epidemic. The European Union’s antitrust authorities also imposed a fine of 7.8 million euros on Valve and other game developers. Regarding the development in other jurisdictions, this project will also be supplemented by specific cases from other Asian countries, which would be helpful to understand the importance of competition law enforcement agencies both internationally and domestically in the era of great economic changes. After investigating the issues of policy implementation, with a focus on the specific operations and judgments of the competition law authorities of various countries during the COVID-19 pandemic, this project aims to distill theoretical insights and specific enforcement suggestions for Taiwan’s competition law and the governmental authorities. Finally, the research team aims to organize an expert consulting workshop, and invite practitioners and scholars in competition law and related industry to attend the event (to be hold in-person or online will depend on the COVID-19 pandemic situation). The main purpose of this expert consulting workshop is to ensure that the specific law enforcement and reform suggestions made by the research team are compatible and reliable. Eventually, this project aims to provide forward-looking industry vision which can cover all relevant fields and key issues.
