"我國實證法上採強制會員制之規定者甚多，但司法實務及學術界對此之研究卻極少。強制會員制限制人民之基本權，特別是結社自由，故其合憲性常遭質疑。我國關於強制入會之行政訴訟案件有與日俱增之勢，行政院法規會亦將「業必歸會」列為年度法制研討會之主題，應是已意識到強制會員制的法制問題及其急迫性。德國強制會員制度之發展、司法實務之見解以及學術界之研究，較之我國相對完善。本研究計畫希望能藉由比較德國法制，提供我國制度上之參考。" "Compulsory membership is ordinary rule in the legal system in Taiwan. But the research in judicial practice and in the literature is rather few. The constitutionality of the compulsory membership is always criticized because it encroaches on civil liberties of the people, especially the freedom to form associations. The cases related to Compulsory membership in the Administrative Courts are ever increasing. The Executive-Yuan notices the problems and makes it topics of the symposium of this year. The development of the compulsory membership, the judicial practice and the discussions in the literature are better developed in Germany than in Taiwan. This study compares the system in Germany and in Taiwan, and tries to make some suggestions for the domestic legal system."
