"我國現行法制中有許多「自治」制度，例如地方自治、大學自治、國會自治、法官自治、私法自治等，惟此等「自治」之內涵如何，相關實務見解與學術研究卻相當貧乏，以致衍生許多法制上的難題或矛盾現象。例如最近所發生的一些與「自治」有關的社會現象，法制上究應如何解決，即眾說紛紜。這種情形激發了本研究計畫之構想。希望藉由本研究計畫釐清下列問題：各種自治之定義及其概念要素、自治之法律性質、自治之民主正當性、自治之憲法或法律基礎、自治任務之界限、自治人民之權益如何保障。" " There are many different “autonomy system” in domestic legal system, e.g. local “autonomy”, university “autonomy”, parliamentary autonomy, judicial autonomy, private “autonomy”. But in judicial practice and in given literature it lacks discussions about the content of autonomy. And that lead to problems and conflicts. For example, phenomena relating to the concept autonomy occur recently, but nobody knows how to explain it exactly. These situations stimulate the idea of this study. This study will provide answer to following questions: definitions and characteristics of different concepts of autonomy, legal nature of autonomy, legitimating of autonomy, the constitutional or legal basis of autonomy, limits of the autonomous functions, and legal protection for the people under autonomy."
