關於公益法人制度，先進國家多已揚棄傳統狹隘見解，不再事公益活動為政府之專權，而鼓勵民間組之積極參與，因而積極鼓勵民間成立公益法人，於法制上亦將原先之諸多限制鬆綁。與我國國情相近之日本，於2008年全面性修正非營利法人制度，改採準則主義，以利非營利法人之成立，其中服合公亦認定基準之非營利法人，則認定其為公益法人，於稅制上給予種種優惠措施，以鼓勵民間從事公益活動。台日兩國國情相近，本計畫將以日本2008年重建之公益法人制度為主要參考對象，檢討我國之公益法人制度，以提出改進之建議。
