Description

Abstract
造紙業在面對數位化及環保時代的大趨勢下,勢必需要進行激烈的產業轉型以及多角化經營來適應新的經濟模式,然而工業用紙的產業結構集中且產品同質性高,存有聯合行為之誘因,另外在數位化的過程及環保意識與企業社會責任的日益高漲下,新型態的產業變化亦有可能造成市場的不公平競爭。 是以,研究團隊將解析工業用紙之產業結構,針對「數位化」、「環保綠能」等重要議題,掌握產業經營策略及未來展望,再透過競爭法主管機關的視角,蒐集並分析國內外關於競爭法主管機關對於數位化時代下工業用紙相關產業所為之特別處置以及重要案例。相關重要議題包含「OECD競爭法委員會提出之相關案例」、「工業用紙與環境保護」、「相關產業上中下游與競爭法之相互關係與重要議題」、「未來公平會對於工業用紙產業於數位化時代下執法之建議」等重點。透過蒐集重要國際機構與國內相關政策、法院判決見解、學術研究報告資料,掌握國內外關於工業用紙產業於數位時代下競爭法應用之發展,以提出公平會未來可供參考之執法措施。 另外,研究方法包括蒐集國內外相關案例,藉由掌握相關案例的國際發展,以協助委託機關建立處理原則。以工業用紙產業為分析對象,分別以「數位化」、「環保」為重要議題,廣泛蒐集並分節撰寫美國CopyTele公司控告元太科技意圖壟斷電子紙顯示器市場而違反競爭法案,韓國Gmarket濫用市場力案、NAVER 濫用市場優勢地位案、ebay與Gmarket結合案,以及其他歐洲及我國案例,深入研析數位化時代下工業用紙產業對於競爭法影響之重要議題與政策執行,並分析產業上中下游之結構及環保議題之內容。 最後,研究團隊規劃辦理1場專家座談,邀集競爭法與產業界相關之專家學者參與座談會(未來視疫情狀況研議是否改以線上方式舉辦),確保研究團隊提出之具體執法建議兼容實然面與應然面,更能夠以前瞻性之產業視野,涵蓋所有相關領域。 Amid the trend of digitalization and environmental protection, the pulp and paper industry has to undergo a massive industrial transformation and diversification of business to adapt to the new economic model. However, since the industrial structure of industrial paper is concentrated and the product homogeneity is also high, there is an incentive for concerted action as a result. Additionally, in the process of digitalization, along with rising environmental awareness and corporate social responsibility, new forms of industrial changes may also cause unfair competition in the market. Therefore, the research team will analyze the industrial structure of industrial paper with a focus on important issues such as “digitalization”, “environmental protection and green energy”. The research team aims to first grasp the industrial business strategy and its prospects, and then through the perspective of the competition authority, collect and analyze both the particular treatments and important cases of domestic and international competition authorities toward the industrial paper and its related industries in the digital age. Relevant important topics include “Relevant Cases raised by the OECD Competition Law Committee”, “Industrial Paper and Environmental Protection”, “The Interrelationship Between the Upstream, Midstream, and Downstream of Related Industries and Competition law and its Key Issues”, “Future Fair-Trade Commission’s Recommendations on Law Enforcement toward the Industrial Paper Industry in the Digital Age” and other significant issues. Through the collection of relevant policies from both domestic and important international institutions, court judgments, and academic research reports, we can chart domestic and international development of competition law’s application in the industrial paper industry in the digital age. In this context, the research team is able to propose law enforcement measures that the Fair-Trade Commission may refer to in the future. Furthermore, the research methods include collecting relevant domestic and international cases, aiming to assist the Fair-Trade Commission to establish specific guidelines by investigating the international development of those cases. Taking the industrial paper industry as an object of analysis, this project will focus respectively on “digitalization” and “environmental protection”. Based on that, the research team plans to extensively collect, write and compose cases of “US Company CopyTele sued Yuantai Technology for violation of competition law on the basis of its intent to monopolize the electronic paper display market”, “The abuse of market power by South Korea’s Gmarket”, “The abuse of market advantage by NEVER”, “the merger between eBay and Gmarket” and other European and domestic cases in Taiwan into different sections. The research team also decided to conduct an in-depth study and analysis of the crucial issues and policy implementation raised on the basis of industrial paper industry impact on the competition law in the digital age, and to also analyze the whole industrial structure of the paper industries including the upstream, midstream, and downstream as well as other relevant environmental issues. Finally, the research team aims to organize an expert consulting workshop, and invite practitioners and scholars in competition law and related industry to attend the event (to be hold in-person or online will depend on the COVID-19 pandemic situation), so as to ensure that the specific law enforcement suggestions put forward by the research team are compatible with both what it is and what it ought to be, and to further enable one to have a forward-looking industrial vision, covering all relevant fields.
