臺灣四面環海，資源有限，大部分物資進出口必須仰賴海運運送，供應國計民生需求，實為典型海島型國家。自遷臺以後，於政府和航運公司的長期努力下，我國航運業在國際上占有一席之地。因應國際政經環境之變化，我政府須時刻檢討應對措施，以利國家發展及符合國內產業營運需求；故而，政府監督管理航業經營之航業法及其相關法規，亦需因應國內外政經情勢變化，適時提供法令修正案之準備資料與研析意見，以利提供修法並創造我國航運產業發展最有利之商業環境。本研究計畫案乃係針對航業法修正之研析，探討以下議題：(1)加強營運人責任保險相關議題、(2)加強船務代理業對代理外籍船舶所應負擔之責任及可行作法、(3)評估國內客運固定航線之相關規範、(4)研議航運業財務監理納入航業法規範、(5)我國海運產業適用租稅優惠及投資抵減之法益、(6)其他相關重要議題。Taiwan is an island which has limited resources. In order to supply the domestic demand, goods and materials are highly depended on import and/or export via shipping transportation. Therefore, Taiwan belongs to a typical sea-island country. Since moved to Taiwan, the Government and shipping companies have been working hard for a long time; hence, nowadays Taiwan has established a very strong shipping industry. Responding to the changes of global economic and political environment, our government must be self-critical about the policies around the clock, so as to both advance country’s development and achieve the demand of domestic industry operating. In other words, the government not only supervises the Shipping Act and the related regulations on shipping operations, but also responds to the various situations of domestic and foreign politics and economics. It is necessary to provide the information and the comments of the policies updating on time, and to help for creating the best commercial environment of our shipping industry development. This research project explores the following important issues: (1) enhancing the operators’ liability insurance, (2) enhancing shipping agent’s responsibility when acting as a foreign agent and practical approach, (3) discussing governing regulations on domestic passenger shipping routes, (4) investigating supervision on shipping operators’ financial situations, (5) exploring tax incentives and investment relief for shipping operators, (6) the other related important issues.
