歷史

本計畫研究架構，始於墨西哥權利救濟制度；執行之初，擬先蒐集整理相關文獻，憑以查悉墨西哥權利救濟的處理模式，接著回歸法制史，分析16至20世紀初期，關於「amparo」制度的演變。特別值得一書的是，本研究在結論部分，擬對近代的墨西哥與我國權利救濟法制互做比較，從中觀察彼等於法條適用、審查標準、保護政策形成等主要程序，如何運行實作，再將其與我國現行法制政策兩相對應而並論之。待各階段完成後，備妥前揭研究結論，做為本計畫成果報告，應能析理透徹而有所啟發。
