Abstract

本研究目的有三重：首先是深化我國對於基礎條約法的條約解釋研究。其次，近年關於演進解釋的研究，在國際法學術與實務界已引發了一些跨幾個國際法次領域的對話，使得該主題蘊含著許多的創新與進展空間。最後，本研究預期根據研究成果，可以洞悉國際條約在不經過修訂過程的程序，就可能為既存國際多邊或雙邊條約架構增添新意。當中的政策意涵，將包括對我國參與國際組織時，為我國涉外人員所需要的條約解釋技巧作知識上的準備。
