標題: | 談網路戲謔仿作的合理使用:比較英國、臺灣著作權法之規定 | 其他標題: | The Application of Fair Use Doctrine Regarding Parody Works on the Internet: Comparing UK and Taiwan Copyright Regulations | 作者: | 江雅綺 | 關鍵字: | 戲謔仿作;合理使用;著作權;改作;侵權;Parody;Fair Use;copyright;Adaptation;Copyright Infringement | 公開日期: | 二月-2016 | 卷: | 8 | 起(迄)頁: | 153-173 | 來源出版物: | 開南法學 | 摘要: | 網路時代的現象之一,就是網友力量大。每當有受網友關注的時事或話題出現,許多網友就會利用網路上抓到的影音檔案與圖文資料、再加料「kuso」成為「網路戲謔仿作」的案例。類似的行為,一方面顯現了網友的創意,另方面達到嘲諷時事或名人、或博君(其他網友)一笑的目的,也同時讓網路成為一個更加活潑奔放的言論環境。但由著作權的角度而言,網路的各種戲謔仿作乃是基於原作的改作作品,涉及原著作部分或全部內容的利用。沒有得到著作權利人的授權所為之戲謔仿作,可能侵害了著作人的改作權、以及著作人的同一性維持權。不過,於網路戲謔仿作之情況,未經授權而利用其他人之著作,倘若構成合理使用,則不會成立著作權的侵害。簡單來說,「合理使用」的規定,是著作權為了保障公益、限縮著作權人的私益。因此,本文想探討的問題即是:網路時代層出不窮的戲謔仿作行為,是否應明文列為著作權「合理使用」的類型、以鼓勵網友的創意、讓網路文化更加活潑發展;或者,僅援引著作權概括性的合理使用條款、就具體案例逐一判斷其要件即可。以下,即舉去年修法中新增戲謔仿作為合理使用類型的英國、與先新增再刪除的台灣著作權法修法為例,比較兩者的差異,與修法時的考慮 |
描述: | One of the most noted phenomenon in the digital age is the rising power of the internet users. Each time when a topic goes spiral on the internet, the internet users are used to copy materials found on the internet and make adaptation based on the materials for sarcastic or comic purposes. This so-called “parody” work not only shows the creativity of internet users but also reflects the vibrant culture in the digital age. Nonetheless, speaking from the copyright’s perspective, “parody” is a derivative work based on the original one, which might infringe others’ copyright without copyright owner’s permission, unless it passes the “fair use” test. To weigh between the parody culture on the internet and copyright protection, it is now a hot debate in the copyright field that whether “parody” should constitute an individual type of copyright exemption, the users of the original works can argue for exemption even without the copyright owner’s permission, or “parody” should be examined by the four elements of the “fair use” doctrine. Intriguingly, UK has adopted the former approach in the recent copyright act reform in 2014,making “parody” an individual type of copyright exemption, while Taiwan sticks to “fair use” approach thus far. Against this background, this article intends to briefly introduce the new parody exemption article introduced by the UK and compare the considerations of Taiwan copyright reform regarding “parody” issue. |
