Abstract
在今日,社會給付之提供,多以當事人提出申請作為行政機關啟動給付准駁決定程序之始點。此際,為使符合法定資格要件之受領權人可依其選擇確實受領必要給付,有關申請資格或申請程序等必要資訊之提供,自屬不可或缺。雖說我國對於社會給付決定之事前調查程序散見於部分個別法令規定中,但現行法上並無類似德國社會法典所定行政資訊提供義務等申請人程序權利規定;於法解釋上,行政機關就社會給付之提供,是否負有資訊提供義務,非無疑義;而於實務運作上申請人或因錯誤訊息傳送或行政機關怠於或違反資訊提供義務而衍生不少爭議乃至於爭訟事件,亦時有耳聞,非無進一步檢視並充實我國社會給付行政程序規範之必要。是以,本專題計畫係以社會給付程序中行政機關對於申請人提供行政資訊義務之必要性及其具體內容為研究對象;擬從程序權利保障觀點切入,檢視我國現行社會立法中,申請人在給付申請程序開啟前或程序進行中―其參與行政機關所為事前程序之資訊蒐集或加工過程時的法律地位,特別是行政機關對於各該申請人等是否有提供必要資訊等說明義務,並評析相關行政法院裁判決,以梳理行政資訊提供義務在我國現行法上的法律依據與法理論基礎;同時,亦將以同樣在現行法上未明文行政資訊提供義務之日本法為比較研究之對象,縝密分析日本迄今行政資訊提供義務違反國賠事件判決法理與學說動向,與我國現行法制進行比較分析,旨在明確社會給付程序中行政資訊提供義務的核心概念及其外延,並嘗試提出行政資訊提供義務之類型及其制度化方向;期能以本研究成果提供作為我國相關法制發展之參考或為相關法理論進一步深化之基礎。To give the social benefits, currently most of times the applicants have to submit the applications to the administrative agencies as the first step to begin the decision procedures. Meanwhile, the applicants could decide whether to submit the applications or not by providing the needed information on the procedures and the criteria of qualifications. In Taiwan, the preliminary investigation procedures for determining social benefit decisions are partly scattered at each legal regulation; however, our current laws do not have similar provisions of administrative information obligations, such as the German Social Code. Meanwhile, apparently there is doubt that the administrative agencies have provided needed information, explanation or illustrations for the applicants. There were a few arguments and even law sues between applicants and administrative agencies due to presenting wrong information, misinterpreting or violating the obligation to provide the sufficient information in Taiwan. It’s necessary to review and improve the rules of the social administrative procedures. So this research will focus on the necessity and contents of the obligation to provide administrative information to applicants. To review our current social laws from the perspective of protecting the rights of the procedures, the legal statuses of the applicants before or between applying for the social benefits while the administrative agencies collecting or processing their information. And analyze the decisions of the Taiwan Administrative Court. At the same time, we will do the comparative study with Japanese law, analyze the cases of state compensation lawsuits in Japan for breach of duty to provide information, and examine the legal theories involved. The object of this research is to give clear guidelines on social payment procedures and try to offer the categories of providing information and standardized the system. Hopefully, the result of this research could offer some references for the development of our legal system and a basis for deepening the relevant legal theories.
