Abstract
2020年是全球檢視透過海洋保護區(marine protected areas, MPAs)實踐海洋資源保育效益的關鍵期間,是《愛知目標》設定之MPAs目標年、也是《聯合國海洋法公約》架構下正在進行的包含使用海洋資源保育區劃管理工具(area-based management tools, ABMTs)如MPAs來養護國家管轄權外海洋生物多樣性永續利用談判期間。同時,2020年是海洋保護區推手--國際保育聯盟(International Union for Conservation of Nature, IUCN)籌備與舉辦具國際海洋保育議程設定影響力之海洋保護區相關會議之會期,更是我國《海洋保育法草案》的起草時間。因此,現在至未來的幾年內,是國內外檢視海洋保護區治理成效與改善現有架構的重要契機。回顧臺灣的MPAs,發現到現有MPAs在制度方面,由於主管法令不同,使得劃設目的、過程、治理方式等皆缺乏一致性與系統化,且缺乏國際思維。然而,海洋具有整體的特質,現有的分散式與本地化的治理架構,不僅使政治資源難以整合與分配、也較少善用國際實踐經驗,提升本國海洋資源養護成效。因此,建立與國際接軌的整合型海洋保護區治理制度,無疑是臺灣海洋資源養護當前的關鍵課題。本研究目的有三:(一)追蹤與研析最新全球共同實踐的原則與內涵;(二)比較研究先進國家美國與澳洲海洋保護區制度之整合模式,了解整合結構與脈絡;(三)結合前述分析,建立可實踐的整合型海洋保護區治理架構方案。本研究結果將有利於促進改善現有的海洋保育治理制度,貢獻於具跨學科特色之海洋保護區治理領域,以利未來相關研究發展。 The year 2020 is a target for the globe to review the progress of designating marine protected areas (MPAs) to conserve marine resources. For example, it is the international spatial target year for protected areas coverage written in the Aichi Biodiversity Target. 2020 is also a critical time for negotiating a new governance mechanism of area-based management tools (ABMTs), including MPAs to conserve marine biodiversity beyond national jurisdiction under the UN Convention on the Law of the Sea. Furthermore, International Union for Conservation of Nature (IUCN), a global MPA facilitator, is preparing MPA related global congresses, which often produce influential instruments and documents to the future developments of marine conservation. Most importantly, the year 2020 is the period where Taiwan’s government is drafting a new marine conservation-related law. Therefore, in the present and near future, now is a critical opportunity for the globe and Taiwan to review and improve MPA governance system.Reviewing Taiwan’s MPA governance mechanism, there is a high diversity of regulations and authorities and is lack of an international perspective. It has lead to a wide range of MPA goals, inconsistent designating processes and fragile governance. However, in the globalization, oceans are seen as a whole. Such unintegrated governance mechanism has brought challenges to the effectiveness of conservation. Therefore, establishing an integrated MPA governance framework is a key to improve Taiwan’s MPA practice. In order to do so, the three objectives of the study are: (1) to track and analyze the latest developments and principles of MPAs at the global level; (2) to conduct a comparative research on the US’s and Australia’s experiences on developing integrated MPA governance systems; (3) to articulate an integrated and practicable MPA governance framework. The findings of the study would be beneficial to improve the current MPA system and contribute to academia who are interested in this research field.
