自治行政為重要的國家組織原則，但國內對於自治行政的認識，大多是侷限於討論地方自治，而不及於各種形式的功能自治。我國現行法制下的功能自治，勉強言之，有大學自治以及農田水利會自治。而農田水利會為我國最早之公法人，在我國行政組織發展史上有其特殊之地位。因此本研究計畫特別以農田水利會為例，作為探討我國功能自治法制之開端。我國的農田水利會歷史悠久，對於台灣的農業發展，貢獻良多。雖然今日農業已日漸退居次要地位，但由於全球水資源日益匱乏，水資源管理已經成為二十一世紀最重要議題之一，而農田水利會作為水資源最重要的擁有者及管理者，其重要性反而與日俱增。而如此重要的農田水利會，其法制卻不甚健全。由於法制有漏洞，所以引起政客覬覦，眾所周知，農田水利會在我國早已非單純的農田灌溉排水組織，而是淪為政治角力的戰場。再加上將來水資源的豐厚利益，可以預見競爭勢必日益激烈，而巧取豪奪亦將層出不窮。但以現行殘缺的法制，防弊尚且不足，奢談興利。如何回歸自治原則，擺脫政治干預，建立可長可久的農田水利法制，實已刻不容緩。本研究計畫案之提出，希望能從功能自治的角度切入，全面檢討我國農田水利會法制之疑義與缺失，並藉助德國水利會自治之理論與經驗，以建構農田水利會自治之法制，提供將來修法革新之參考，同時也希望喚醒學界與實務界對於此一問題之重視。 "Self-administration is an important principle of the state organisation. It consists of local Self-administration and functional Self-administration. There are two kinds of functional Self-administration in Taiwan, i.e. the Self-administration of University and the Self-administration of the Irrigation Associations. At the beginning of the research about functional Self-administration in Taiwan this project takes the Self-administration of the Irrigation Associations as example. The Irrigation Associations in Taiwan have a long history. They are the most important organization of the farmers and contributed to the development of agriculture very much. Although agriculture withdraws slowly, the Irrigation Associations still play an important role in Taiwan because of the scarceness of the water on earth. So important they may also be, so defective is their legal arrangement. For a long time the Irrigation Associations in Taiwan are not only a farmer organization, but also an important combat scene of the policy. The struggle for power is ever more violent, in addition comes the enormous interest of the water resources. The reform is therefore unavoidable and immediate. With this study the author would like on the one hand the current situation to examine and criticize, on the other hand in addition, ideas offer, which are for the future reform of the legal regime of the Irrigation Associations usable."
