本計畫主要研究主題為：以航空器進行救護行為時，得否對使用人進行收費？從我國目前實務現況發現，人民因進行高山活動頻率增加，過程中因發生意外事故而有使用航空器救援之比率亦顯著提升，但其中不乏有濫用之情形。針對濫用航空器之情形，行政機關得否收取使用對價？檢視相關法規後，發現我國相關法制付之闕如，故擬參酌外國相關法制經驗，並綜合我國國情，研析設置收費標準之可行性。本研究擬採文獻分析法、外國比較法制研究法、訪談研究、量化分析等方式，作為研究方法，並分階段實施，兼顧學理與實務之需求。最後，提出相關法規範修正之建議版本，以供機關參考，作為下一步推動政策之重要依據。This article aims at charging for Search and Rescue(Hereinafter referred to as SAR) According to the recent practice, more and more people go mountain climbing. There was a noticeable increase in SAR when the accident occurred. However, there were some misuses. Whether the administration can charge for SAR so as to settle the abuser? After reviewing the regulation, we find out lack of regulation. This article will refer to foreign regulations and experience, and take national conditions into account so as to analyze the charge for SAR. This article will take Document Analysis, Comparative Research Methods, Interview method and Quantitative analysis as the methods used. Meanwhile, it will periodically permanent and conform the demand. At last, it will provide the amended regulation so as to drive the policy.
