Description

Abstract
臺灣自民主化以來已歷經三十餘年,分期付款式的民主轉型並未使威權統治的遺緒隨著政權和平更替而消失,直至第三次的政黨輪替,政府始開啟轉型正義的國家工程。2017年,我國通過並公布施行促進轉型正義條例。 為確立自由民主憲政秩序、否定威權統治之合法性及記取侵害人權事件之歷史教訓,該條例賦予促進轉型正義委員會處置威權象徵之任務,以威權統治者命名之街路即屬轉型正義所欲處理之範疇。惟該條例第 5條第 1項未賦予主管機關執行任務時之強制力,條文所稱「其他方式」亦使部分配合單位或有不明確的空間。查政府部門執行清除威權象徵所可能的困境包括:因中央政府與地方自治團體間之權責關係再釐清,以及因路名更動可能牽涉人民權益,招致部分民意質疑等。本研究以威權統治者命名之街路更稱為例,分析可能之法律爭議,並藉由民意調查、個人深度訪談與焦點團體訪談,探詢街路更名可能的方案。希望藉由相關評估結果,提供中央各部會在未來踐行該任務時之參考,並可思考尋求有推動意願的地方政府進一步建構協作模式,逐步策進威權路名的更改與變遷,俾促進轉型正義之確切落實。 Taiwan has steadily developed its democracy over the past 30 years; however, the legacy of authoritarian rule continues to exist. Not until the 3rd transfer of power between rival parties did the government start tackling the issue of ‘transitional justice’ nationwide. In 2017, Taiwan’s Congress (Legislative Yuan) passed the Act on Promoting Transitional Justice. In order to establish a liberal democratic constitutional order, to deny the legitimacy of authoritarian rule, and to memorize the historical lessons of human rights abuses, the Act tasks the Transitional Justice Commission to remove authoritarian symbols in public spaces, including renaming streets initially named after authoritarian rulers. Nevertheless, given that Article 5, paragraph 1 of the Act does not legally compel governmental agencies and private sectors to do so, and the wording ‘in some other way’ leaves much room for interpretation, the progress of street-renaming has been very slow. The obstacles that the governmental agencies may face include the disputes over whether this affair shall fall onto the central or the local governments, and how the name-changing may impact the residents living on the streets. This research conducts legal analysis, surveys, in-depth interview, and focus group interviews to seek the possible approaches to renaming the streets titled authoritarian rulers’ names. It is hoped that the research findings can provide both the central government and local governments a legal and administrative framework for future reference in discourses and practices, and facilitate the implementation of transitional justice in Taiwan.
