Description

Abstract
1996 年聯合國國際貿易法委員會(UNCITRL),委託國際海事會議(CMI), 整理既存規範國際海上貨物運送的國際公約包括海牙規則、海牙威仕比 規則、漢堡規則、多式聯運公約與國際商業習慣,以為針對國際海上貨 物運送法不足之處,建構統一的規範。CMI 確認研究議題為: 碼頭裝卸 業與港區倉儲業責任、戶到戶的物流、滯留櫃、運送人責任之調整、運 送契約權義之移轉、無紙化的電子運送紀錄、定期批量契約(volume contract)、運送人之辨識、託運人責任、國際裁判管轄權等。CMI 於2002 年提交UNCITRL 全程或部分海上貨物運送契約公約草案,歷經8 年的折 衝,聯合國大會於2008 年12 月11 號通過全程或部分海上貨物運送契約 公約(簡稱鹿特丹規則),並於今(2009)年9 月23 日於鹿特丹舉行公約簽 署儀式,首批16 個簽署國家包括美國、荷蘭、挪威、法國、丹麥、希臘 等海運強權國家。對於公約法定需達到20 個締約國的生效限制,根據聯 合國預測,即可能在兩年中達成。屆時國際海上貨物運送法,即展開全 新的歷史階段。本計畫藉由文獻探討、實證研究與舉辦座談會之方法, 提出我國法之因應方案。In 1996, UNCITRAL requested the CMI to gather information about current practices and laws in the area of international carriage of goods by sea such as Hague Rules, Hague-Visby Rules, Hamburg Rules, Multimodal Transport Convention and the practices, with a view to establishing the need for uniform rules in the areas where no such rules existed. The CMI identified the issues where to be further studied: the liabilities of port and terminal operators connected to marine transport、the door to door logistic、overdue containers, the adjustment of carrier’s liability、electronic transport records, volume contract, identification of carriers, the transfer of rights and obligations via transport documents, obligations of the shippers and the jurisdiction etc. The CMI submitted to the UN a Draft Instrument on Contracts for the International Carriage of Goods Wholly or Partly by Sea for consideration in 2002. For eight years of negotiations between the member states, the UN assembly finally concluded the Convention (the Rotterdam Rules). The UN Convention has opened for signatures since 23 September 2009. The official Signing Ceremony took place in Rotterdam, the city after which the UN Convention is named. Sixteen states, including those maritime states USA, Denmark, France, Greece, the Netherlands, Norway and Spain. The UN predicted that the Rules will come into force within 2 years and the international law of carriage of goods by sea will thus step into an all new era. This project is thus planned and expected to submit the solutions to respond to the new development via the methodologies of bibliography review, empirical legal research and holding seminars.
