Abstract
本研究經由法學實證與法學論理的分進與合擊, 藉此分析我國法院對於海商法上法律問 題的見解, 並以國際主流價值為對照, 提出我國制定法與實務見解之缺失, 與改進意 見。本研究計畫區分為兩大部分。第一部分為我國法院判決實證統計與對學者、實務家、 使用人(user)的訪談與問卷調查,將在第一年進行。第二部分為國際主流價值的確認, 進 而作為海商法或法院實務見解妥適性的評析基礎,將在第二年、第三年進行。並在第一 年度與第二年度舉辦國內研討會, 第三年度舉辦國際研討會, 將國內外學者與實務家的 意見作為本研究期末成果予以修正之重要回饋機制,以提高本研究成果之實用性、可接 受性與研究水準。以期能加以落實國家海洋政策、發達知識經濟的海商法產業、累積海 商法學研發的實力與人力資源、促成海商法的增修與國際主流價值接軌,並作成司法判 例與建構海商法資料庫。 This project is going to analyzes maritime law cases in the courts of Taiwan by both empirical and rational legal research and compared with those of ‘international rules of standard’, in order to identify the defects of the Maritime Code and court practice, and then submit solutions for rectification. This project is divided into two parts. The Part one is to have a empirical research on the court cases and designs questionnaires to find out some data from the users such as scholars and practicing lawyers, which is to be processed in the first year. The Part two shall focus on the ‘international rule of standard’formed the basis for the appropriateness of the law and court practice, which shall be proceeded in the second and third years. Two domestic seminars shall be held respectively in the first and second year, and an international seminar shall be projected at the third year, which is a very important feedback mechanism via the attendance of domestic and international experts, to enable to promote the research level to an international standard. The goal of this project is in five aspects: first to carry out state marine policy, second to promote the maritime law industry, third to promote the research standard and human resource in maritime law, fourth to promote the amendments of Maritime Code in line of international rule of standard and final to construct a maritime law data bank for the court cases.
